PRINCIPLE TERMS

  1. This agreement commences once you have indicated your acceptance of our Terms and Conditions in the declaration section of the web sign-up process and clicked the JOIN NOW button.
  2. All new memberships are subject to the approval of the management. The management reserves the right to reject an application for membership to the Gym for any reason whatsoever, in their absolute discretion.
  3. Your membership starts immediately (or when the Gym opens in the case of a pre-sale membership).
  4. This agreement will become binding on you and us and you will be entitled to all the rights and privileges exercisable for the type of Membership chosen.
  5. You cannot transfer this agreement to anyone else.
  6. The Laws of the United Arab Emirates shall govern the Terms & Conditions, without regards to conflict of laws principals. All disputes arising in connection therewith shall be heard only by a court of competent jurisdiction in U.A.E.
  7. We will not trade with or provide any services to OFAC and sanctioned countries.
  8. The United Arab Emirates is our Country of Domicile. BOOM GYM UAE controls this site from the U.A.E. BOOM GYM UAE makes no representation that this site is appropriate for use in other locations. If you use this site from other locations you are responsible for ensuring compliance with local laws. You may not use, export or re-export any materials from this site in violation of any applicable laws or regulations, including, but not limited to any U.A.E export laws and regulations.

PHYSICAL HEALTH OF MEMBER

  1. In accepting these Terms & Conditions the member warrants and also represents that he/she is in good health and is not knowingly incapable of engaging in either active or passive exercise. The member further warrants that such exercise would not be detrimental to their health, safety, comfort, well-being or physical condition.
  2. The member shall not use any BOOM GYM UAE facilities whilst suffering from any infections or contagious illness, disease or other ailment such as open cuts, abrasions, open sores or minor infection, where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other members.
  3. Before using a BOOM GYM UAE facility, the member or visitor must read and confirm the agreement of our Member Health Declaration Form.
  4. If a member is taking medication and is aware of a condition that may affect them taking part in exercise a doctor’s letter would be needed.

PAYMENT POLICY

  1. The “Monthly Recurring Payment” or “Recurring Payment” means the BOOM GYM monthly membership fee corresponding to the purchased membership option (e.g. Fixed Term or Flexible – Installment), and determined by the membership type and membership term at the point of joining.
  2. The monthly membership fee or Monthly Recurring Payment is due each month in full, upfront, in advance and with the exception of cancellations under the terms detailed below, no partial refund of the monthly membership fee.
  3. Monthly Membership Fee is guaranteed so long as the member remain a member in good standing including payment of all monthly dues.
  4. This membership will renew automatically on a month-to-month basis if written notice of cancellation is not received seven (7) days prior notice to the last scheduled Monthly Dues payment under the original term of this Agreement.
  5. Payment Methods
    Boom Gym offers various payment methods and as described below;

    • Credit / Debit Card
      Boom Gym has a third-party channel that processed payments through credit or debit cards. It is indicated in the User’s Terms & Conditions that you agree that a third-party will do the procedure for the transaction using Card payments.
      Using the Card payment and/or the Bank Transfer, the client is required to provide the banking information needed to be able to receive payment from the transactions.
    • Transfer / Remittance
      Boom Gym is available in bank transfer payments. The transaction can be done through Automated Teller Machine or Internet Bank Transfer to our Boom Banking Accounts. The process for this transaction is:
      Once the client has paid through Bank Transfer, he/she is requested to provide a copy of the transfer receipt to the Boom Gym which can be forwarded to our email at info@boomgymuae.com

    • Cash
      Boom Gym discourages payment of cash transactions at all circumstances, however if cannot be avoided which may be dealt on case to case basis.
      Instead, it is recommended to conduct the Cash Deposit to the nearest ADCB Bank at Al Mariah Mall with details below. Cash payment should amount to the membership type and be received at the counter.
      Refer to “Cash Handling Policy” if cash transactions for membership payment cannot be avoided.
  6. Boom Gym will not be liable and would take no responsibility for any loss or damages that may occur from the wrong payment information and/or remittance by the client.
  7. Boom Gym has the right to verify the authorization of the Buyer in using the certain payment method.
  8. Boom Gym may suspend or cancel the transaction if the authorization is not available.
  9. The Management reserves the right to periodically review their prices, charges and fees and implement these accordingly.
  10. The Management will cancel any membership on which fees are unpaid for thirty (30) days, thereafter the Management also has the right to continue to attempt to charge for these dues accordingly. Legal action will be taken to recover any outstanding dues from the member. You may not rejoin any of our gym until the outstanding amount is paid.

This policy is approved by the undersigned and is supported by all the levels of management within the organization.
All personnel shall be guided by the contents of the quality management system and no deviation from the methods and procedures set down shall be permitted.[/vc_column_text][vc_column_text]

CANCELLATION REFUND & TERMINATION POLICY

CANCELLATION AND REFUNDS:

  1. Members are entitled within two (2) full days to cancel your membership and obtain a full refund, once you have visited us for the first time within these two (2) days, you have forty-eight (48) hours after your first visit to cancel this agreement for any reason.
  2. Following the above-mentioned two (2) days period, the initial membership payment and each subsequent Monthly Recurring Payment made is not refundable under any circumstances but you may cancel your membership subject to the following cancellation policies.
  3. We will manage and process the cancellation of your membership upon receipt of a properly submitted cancellation request. Should your Recurring Payment be cancelled without submission of a cancellation request form at any time you may incur fees as a result of any missed payments.
  4. If by reason of death or permanent disability Member is prevented from using a significant portion of gym facilities for which he/she has contracted, he/she shall be relieved from the obligation of making payment for services other than those received prior to the onset of the disability or time of death. If services not yet received were prepaid, the pro-rated amount will be refunded within thirty (30) days. A copy of the death certificate must be sent.
  5. Any request for cancellation by Member, must be in writing and/or personal. This is the only manner by which cancellation of this membership will be granted, subject to the terms and conditions set forth above. A Member’s request for cancellation of membership must be received at least fourteen (14) days prior to the next scheduled Monthly Dues payment date.   6. Member may cancel in case of disability. The definition of permanent disability is a condition of a non-temporary nature which would preclude Member from physically using a significant portion of the facilities for the remainder of the term of the membership and is documented in writing by a physician acceptable to gym.
  7. BOOM GYM will not be liable to the Member for the refund of any additional payments received from Member if the terms and conditions set forth above for cancellation have not been met.
  8. Refunds will be made onto the original mode of payment and will be processed within seven (7) to fifteen (15) days depends on the issuing bank of the credit card (if applicable).
  9. BOOM GYM has strictly no “cooling-off” period.
  10. Auto Renew Subscription Termination all cancellations of auto renewal memberships must be made at least 72 hours before your next payment is due. If member fails to cancel membership earlier than 72 hours before the next payment is due and the membership is auto-renewed, a refund will not be provided. It is the member’s responsibility to cancel your membership within the time frames set out above.

TERMINATION OF MEMBERSHIP

  1. Members applying for ‘Termination’ from their membership must complete a form for the request to take effect the following month. You may address your request for cancellation at this email address info@boomgymuae.com.
  2. All monthly paid memberships are open ended; therefore, we will continue to deduct membership dues until a request to cancel is received from the member. Monthly memberships do not automatically cancel after the initial minimum term indicated. Such requests must be made in writing to the Gym Manager with seven (7) days’ notice period and to consider as the last month of dues. The member shall obtain a confirmation in writing from the gym that the Termination has been applied.
  3. Termination of a membership that has been frozen shall be subject to full monthly dues for the notice period. Freeze period is excluded from the minimum term.
  4. A member whose membership is terminated by the Management shall forfeit all the privileges of membership with immediate effect without claim of any refund of his/her monthly membership dues, other than any monthly membership dues paid in advance. On termination of his/her membership the member will be required to return his/her membership card and any other evidence or property of membership provided to that member by BOOM GYM and shall settle any outstanding debts.

MEMBERSHIP & SERVICE DELIVERY POLICY

MEMBERSHIP:

  1. Memberships are personal to the member and are non-assignable, non-transferable and non-refundable. A member may not loan his/her membership card to be used by a third party. The Company may assign the benefit of these agreements to any person, firm or company at any time without notice to the member.
  2. The membership term starts from the date the applicant has opted as the start date during the sign-up process. However, in any case, the start date of membership shall not be beyond three (3) days from the date of sign-up.
  3. Upon acceptance, the member will be issued with a membership card (which shall remain the property of the Company) and the member shall be entitled to all the rights and privileges under the class of membership purchased. If a membership card is lost or misplaced, the Management will issue a replacement card at a cost AED 100 + applicable taxes.
  4. Any member wishing to enter the gym without a valid membership card will only be admitted at the absolute discretion of the Management. All visitors will be required to purchase a day pass or have an active membership in order to avail the gym services and its facilities
  5. Any member below 16 and above 14 years of age entering the gym must produce a letter of consent by the parent/guardian, however all visits must be accompanied by the parent/guardian will be required to purchase PT and only train in the gym with a Personal Trainer. Members must use their membership card to check-in to the facility each time they visit the gym. If the facility does not have access-controlled gates and/or gates are temporary out of service, members will be required to sign in and provide their details at the receptions.
  6. Membership entitles a member to use of exercise and gym equipment, use of facilities including Locker Room and Shower area while in the gym. Access to all scheduled group exercise classes such as Cross-Fit Zone Area, Indoor Cycling, Aerobics and Zumba classes.
  7. Boom Gym offers a pre-scheduled group fitness instruction from time to time. The number of participants in group sessions may be limited. Group sessions will be made available either on an appointment basis or on a “first come, first served” basis. These classes are strictly informational and instructional in nature and not intended as personal training.
  8. Members having single gym membership can transfer their membership to a higher tier by paying the respective fees.
  9. Management reserves all the right to periodically review or amend prices, charges and fees and implement such revisions anytime.

MEMBERSHIP RULES:

  1. Member agrees to keep and obey all rules and regulations now in force or in the future prescribed by BOOM GYM for the use of gym facilities and the equipment and facilities therein including rules with respect to lockers, attire and personal hygiene. BOOM GYM reserves the right to revoke or suspend this membership, for moral turpitude or fraud. If Member is suspended, member’s obligations to make payments under this Agreement continue as scheduled. Upon entering the gym, Member must register at the reception desk and provide membership identification (and show other identification if requested by receptionist).
  2. The gym’s normal hours of operation are indicated at the entrance and notice board. The Management reserves the right to adjust the hours for the purpose of cleaning, decorating, repairs, and special private functions and holidays. The Management shall endeavor to give reasonable notice of any change in the hours of operation.
  3. Last admission will be allowed one hour before closing and you are requested to leave the gym premises punctually at the time of closing.
  4. Member should be considerate of other members by using their own workout towel, and will clean up his/her sweat after using equipment.
  5. Members are requested to return all portable equipment to the racks provided.
  6. Members unsure about any equipment should consult a member of staff.
  7. Absolutely no gym bags are allowed in the exercise’s rooms. If he/she brings extra clothes or equipment, he/she must check out a locker and use it.
  8. BOOM GYM operates a strict no smoking policy.
  9. Damage to property shall be paid for by any Member who willfully or neglectfully causes such damage. Member is responsible for damage incurred by dependent children or guests.
  10. At BOOM GYM, we practice the highest standards of professionalism and integrity. If any client makes any of our staff feel uncomfortable through, or exhibits any form of, inappropriate or aggressive behavior, our staff have been trained to immediately leave, contact upper management (and the police if necessary). In such an event, the appropriate actions will be taken and all outstanding sessions shall become null and void and no refunds will be provided.
  11. Member shall be subject to the control and guidance of gym staff and follow the instructions of the staff while in the facilities. Member agrees to conduct himself/herself in a quiet and well-mannered fashion when in or about the facilities so as not to cause any disturbances which would interfere with the use and enjoyment of other Members and guests. Under no circumstances will Member use foul, loud, or slanderous language, or harass, molest, badger, or solicit other Members or guests, and under no circumstances shall Member move exercise equipment about, or use the equipment in any manner not authorized by management. Any complaints, other than those of an emergency nature or requiring immediate action by gym personnel, shall be made directly to the manager.
  12. All members and guests are required to wear proper gym attire when exercising and to dress modestly when working out, this includes all areas of the gym. Members should remain modestly and appropriately dressed at all times, including in the changing area.
  13. Temporary lockers will be provided by the gym and must be cleared daily. In no event will anyone be permitted to leave locks overnight on lockers. Unclaimed properties will be kept by the gym for a period of 1 week after which the Management reserves the right to dispose of the items in any way it sees fit. The Management does not take any responsibility for the items kept in the lockers. It is discouraged to keep any money or valuables in your locker. BOOM GYM cannot be held responsible for any loss or damages. If a member loses or damages a key/lock he/she will be responsible to pay a fee to replace the key and/or lockset if necessary. Where a key is issued it remains the property of the Company and must be returned upon termination of the locker rental or termination of membership. In the event of loss, a penalty fee will be charged.
  14. The use of mobile phones with camera features and/or any other types of visual recorders in changing rooms are strictly prohibited. Members breaching this rule will be handed over to the authorities to be dealt with accordingly.
  15. Members or guests may not use the facilities whilst under the influence of alcohol, narcotics or other mood-altering substances.
  16. The Membership permits member to use facilities during the membership term subject to such rules, regulations and conditions of membership as may be in effect from time to time at the gym. Hours and days of operation, rules, regulations and conditions shall be subject to change without notice.

HEALTH AND SAFETY

  1. All members and visitors who are undertaking in any exercise are required to accept our “Health Declaration Form” at the point of registration and before commencing any exercise within the GYM.
  2. Fitness instructors and staff are authorized to stop anyone from exercising if in their opinion the member/guest is exercising in a manner that may result in personal injury and/or injury to others. Users must abide by the guidance of Gym instructors.
  3. While every precaution is taken to maintain safety standards, all equipment and facilities are used entirely at the member’s or guests’ own risk. Any malfunction of equipment noted should be reported to a member of staff as soon as it is noticed.
  4. BOOM GYM reserves the right to close any part of the building or withdraw equipment for conducting essential repairs or maintenance. Prior notice will be given where possible to avoid inconvenience.
  5. For safety purposes kindly use plastic bottles with sports lids for drinks where allowed.
  6. For safety and hygiene purposes, no eating is allowed in any areas not so designated.
  7. In compliance to Covid-19 Restrictions, the use of gym equipment is prohibited to ages below 18 years and above 60 years old. COMPANY will be implementing strict booking policies, booking restrictions and participation measures. BOOM GYM reserves the right to restrict bookings on the booking platforms as is necessary. Failure for any person to adhere to the booking platform, or not follow gym instructions at any point, will result in being banned from the facilities.

DATA SECURITY

  1. In the course of completing your membership and creating the Monthly Recurring Payment, we may collect certain personal information about you including personal details and information about your health and person. We will use this information for purposes including managing your membership and communicating with you. You have the duty to keep your personal information up to date and to inform us of any significant changes.
  2. We will limit access to the processing of and use of your personal information to our employees and management who may, from time to time, require its use for marketing or other services. In addition, from time to time, we may need to make your personal information available to third parties such as legal authorities, our group companies, and professional advisors.
  3. We may also provide your contact information to our business partners and third parties who may contact you about their products and services. Please inform us during the signup process if you do not wish to receive such information.
  4. Please contact us if you have any questions or concerns about how we will use and store your personal information or if you wish to exercise your right to access, modify, object to the use of, or request the deletion of your personal information.
  5. We reserve the right to take photographs of our facilities (which may include you, provided your inclusion is incidental) for press and promotional purposes.
  6. We will endeavor to use whatever method of communication deemed appropriate to notify you of the Gym information in order to best serve your experience and assume that the information provided by you is correct and an acceptable method to provide you with this information.
  7. As a member of the BOOM GYM UAE, you acknowledge that you have read and understood the provisions of this paragraph and that you agree that we may collect, use, process and disclose your personal information as described hereinabove.

DRESS CODE

  1. All members are required to wear proper gym attire when exercising and to dress modestly when working out. Short workout tops that expose the midriff, torn clothes, jeans, denim shorts, and beanie hats are strictly not permitted.
  2. Non-marking, rubber-soled sports shoes/footwear are required at all times in the gymnasium and in the group exercise studios. “Crocs” and “flip-flops” are not considered suitable workout shoes.
  3. Members should remain modestly and appropriately dressed at all times, including in the changing areas.
  4. Nudity is strictly not permitted and members are requested to use the private changing cubicles provided.

LOCKERS

  1. Temporary lockers are provided for the members who shall remove their personal belongings at the completion of their visit. The Gym has the right to cut open any padlocks and remove personal belongings that are left in the lockers at the end of each day.
  2. Unclaimed property over the value of AED50 shall be kept by the Gym for a period of 1 week after which the management reserves the right to dispose of the items in such way it in their entire discretion deems fit. Clothing and other similar items will be disposed of after a 1-week period, however, any items of value will be sold periodically and all proceeds donated to the nominated charity of the Gym, and no claims shall be entertained after this period from members or visitors. Any items below AED50 in value will be immediately disposed of.

BEHAVIOUR

  1. Members and guests must treat BOOM GYM UAE facilities and one another with respect; failure to comply shall constitute a serious breach of the terms of membership, and could result in the loss of membership.
  2. Threatening, intimidating, or abusive behavior will not be tolerated towards any member of staff or the company. Should such incidents take place a member’s membership will be immediately suspended and all future payments will be collected immediately.
  3. We reserve the right to prevent access to, or use of, the facilities by anyone deemed to be acting inappropriately or behaving in an unacceptable manner, as determined by BOOM GYM UAE Management.
  4. As a courtesy to other members, Gym equipment should be wiped down by members after use, and all equipment returned to its correct position.
  5. Any anti-social or offensive behavior will result in the member or guest being immediately evicted from the gym and your membership cancelled.
  6. BOOM GYM UAE Social Media platforms are intended as a means of creating community, facilitating communications, and providing a forum for the expression of feedback. Inflammatory posts, including any content which is judged by our management at its absolute discretion to consider inappropriate, may be subject to remedial action, including removal of the offending posts, blocking access, and termination of membership as a consequence of serious misconduct.
  7. Good personal hygiene is mandatory, and any member who causes offense will be asked to remedy the offending problem or leave the gym and membership may be cancelled at BOOM GYM UAE management’s sole discretion.
  8. Sharing membership cards is strictly not permitted, any member caught sharing membership cards or providing non-members with unauthorized access to BOOM GYM UAE, will be subject to their membership being cancelled and the remainder of their contract period being billed.
  9. Members who are accessing a BOOM GYM UAE location through a complimentary membership – won in a competition, through a BOOM GYM UAE partnership or other promotion, are also subject to these terms and conditions. BOOM GYM UAE management reserve the right to cancel a complimentary membership if the terms and conditions are not being adhered to. BOOM GYM UAE management also reserve the right to refuse access to members accessing the gym on a complimentary membership, in order to abide by any covid regulations currently in place by the UAE government. Members will still be entitled to their complimentary membership but this may have to be used during a non-peak time as per the guidance of BOOM GYM UAE manager or deferred to a later date.

GYM FACILITIES

  1. The management accepts no responsibility for theft or damage to a member’s personal belongings kept in the lockers or otherwise for any reason whatsoever.
  2. The use of mobile phones with camera features and/or and other types of visual records in changing rooms is strictly prohibited, and members are requested to ensure that they do not offend any other person when utilizing such equipment within our facility.
  3. Members and guests are not allowed to bring their own food into BOOM GYM UAE locations.
  4. The normal hours of operation are as indicated from time to time at the Gym entrance and notice board. The management reserves the right to adjust the hours for the purpose of cleaning decorating, repairs, and special private functions and holidays.

GENERAL TERMS

  1. By visiting the Site, you represent, warrant, and covenant that (a) you are at least 18 years old; (b) The customer using the website who are Minor /under the age of 18 shall not register as a member and shall not transact on or use the website.
  2. Soliciting and selling private personal training sessions or merchandise of any type to any member is prohibited and may result in immediate termination of the membership concerned.
  3. The BOOM GYM UAE management reserves the right to use any individual or group photographs or video of members and or guests for press or promotional purposes (by BOOM GYM UAE or our partners) in both online, TV, and print sources.
  4. All members must abide by the Gym rules of the which may be amended and/or added to from time to time at the management’s discretion.
  5. Failure by the management to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.
  6. Members and/or guests are not allowed to photograph or copy any of our facilities’ interior designs, promotional materials, tag lines, themes, or concepts. We reserve the right to proceed with legal action against any member caught distributing, sharing, or supplying such contents to any third-party vendor or competitor.
  7. BOOM GYM UAE will not trade with or provide any services to individuals and companies owned or controlled by or acting for or on behalf of, OFAC targeted countries AND individuals, groups, and entities, such as terrorists and narcotics traffickers designated under the OFAC programs that are not country-specific
  8. The BOOM GYM UAE website may automatically produce search results that reference and/or link to third-party sites throughout the World Wide Web. We have no control over these sites or the content within them. BOOM GYM UAE  does not guarantee, represent or warrant that the content contained in the sites is accurate, legal, and/or inoffensive. BOOM GYM UAE does not endorse the content of any third-party site, nor does it make any representation or warranty about these sites, including that they will not contain viruses or otherwise impact your computer.
